","subitem_description_type":"Other"}]},"item_3_description_46":{"attribute_name":"資源タイプ","attribute_value_mlt":[{"subitem_description":"text","subitem_description_type":"Other"}]},"item_3_description_7":{"attribute_name":"抄録","attribute_value_mlt":[{"subitem_description":"本稿は、近時のペットのファッション化における課題と、加害動物における飼主等の占有者責任について考察するものである。近年の動物愛護の精神の高まりにともない、動物の法的地位はゆらいでいるといわれている。諸外国の法においては「動物は物ではない」との原則が一般的であり、動物の権利能力や法的人格を認める見解も存在する。他方、環境省の統計をみると、動物起因損害のうち犬による咬傷事故について過去10年で毎年約4,500件起きており、その事故件数は減少していない。また、事故を起こした咬傷犬数は、野犬等ではなく飼犬による割合が増加していることが明らかとなった。このような咬傷事故に伴う損害賠償請求訴訟においては、飼主等の動物占有者の責任が問題となる。\n飼主等の不法行為による動物起因の損害を救済する手段として、わが国の民法は718条において動物占有者の責任を規定している。この規定における動物占有者の責任は、民法の原則となる過失責任よりも重い、中間責任とされる。そこで、この中間責任の成立過程と変遷について整理したうえで、動物占有者の責任の免責要件に注目し、本条項が中間責任であるといわれる根拠について考察した。つづいて、動物占有者責任の免責要件に焦点をあてて、これまでの判例を分析した。その結果、動物占有者の責任においては、民法の原則である過失責任よりも立証責任の転換により責任を重くした中間責任が機能しているのではなく、時を経て、危険責任を背景とした判断がなされ、その責任がかなり重くなっている状況が明らかとなった。","subitem_description_type":"Abstract"}]},"item_3_full_name_2":{"attribute_name":"著者(ヨミ)","attribute_value_mlt":[{"nameIdentifiers":[{"nameIdentifier":"7245","nameIdentifierScheme":"WEKO"}],"names":[{"name":"フカマチ,
