年5 月、テレビのリアリティ番組に出演していた女性が、番組内での言動に対してSNS で数多くの誹謗中傷を受け、その後に自殺するという事件があった。この事件はインターネット上の言論が、人を極度に追い詰める暴力となりうることを世に知らしめた。その後、この事件を契機に政治や世論におけるインターネット上の誹謗中傷への対策強化を求める声が高まり、官民の様々な取組が強化されることとなった。\n　近時のインターネット上の誹謗中傷対策の動きとして、プロバイダ責任制限法の改正、侮辱罪の改正があげられる。本稿ではまず、インターネット上での誹謗中傷などサイバーハラスメントの特性について整理した。続いて、プロバイダ責任制限法改正における新たな裁判手続の概要と発信者情報開示制度の課題について言及した。さらに、名誉侵害罪の保護法益について検討し、侮辱罪改正をめぐる議論とその課題について考察した。その結果、多様化するサイバーハラスメントへの対策は取られつつあるが必ずしも十分とはいえず、また、被害者救済と表現の自由との調和において課題があることを指摘した。","subitem_description_type":"Abstract"}]},"item_3_full_name_2":{"attribute_name":"著者(ヨミ)","attribute_value_mlt":[{"nameIdentifiers":[{"nameIdentifier":"9834","nameIdentifierScheme":"WEKO"}],"names":[{"name":"フカマチ,
